1. Overview

These Terms of Service ("Terms") govern your use of the services provided by Pixel Forge Design Limited ("Pixel Forge", "we", "us", or "our"), a company registered in Ireland. By subscribing to or using our services, you agree to be bound by these Terms.

2. Services

Pixel Forge provides UX design, UI design, web development, prototyping, design systems, and related digital services on a subscription basis. The specific scope of services available to you depends on the subscription plan you select.

We reserve the right to modify, update, or discontinue any service or feature at any time with reasonable notice.

3. Subscriptions & Billing

Subscriptions are billed monthly in advance.
Payments are processed securely via our payment provider (Stripe). By subscribing, you authorise us to charge your payment method on a recurring basis.
Prices are listed exclusive of VAT where applicable. Irish VAT may be applied in accordance with applicable law.
Subscription fees are non-refundable for the current billing period, except where required by law.
You may pause or cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

4. Pause & Cancellation Policy

You may pause your subscription for up to 30 days per billing cycle. During a pause, no new requests will be accepted and no billing will occur for the paused period. Unused days will be credited to your account.

To cancel, notify us at hello@pixelforge.ie. Access to the service continues until the end of the paid period.

5. Turnaround Times

We aim to deliver design and development requests within 48 hours on business days (Monday–Friday, excluding Irish public holidays). Turnaround times are estimates and may vary depending on the complexity and volume of requests in your queue.

6. Intellectual Property

Upon receipt of full payment for a given subscription period, all design and development deliverables created specifically for you become your property. We retain the right to display work in our portfolio unless you request confidentiality in writing.

We retain ownership of any tools, templates, processes, or methodologies used to create deliverables. These are not transferred as part of the subscription.

You warrant that any content, assets, or materials you provide to us do not infringe on any third-party intellectual property rights.

7. Client Responsibilities

To ensure timely delivery, you agree to:

Provide clear, detailed briefs for each request.
Respond to questions and provide feedback in a timely manner.
Ensure you have the rights to any assets, copy, or materials you provide.

Delays caused by late or incomplete feedback may affect delivery timelines.

8. Acceptable Use

You agree not to use our services to create content that is:

Illegal, harmful, or deceptive.
Infringing on the intellectual property rights of others.
Discriminatory, abusive, or otherwise objectionable.

We reserve the right to refuse or terminate services for any client in violation of this clause.

9. Limitation of Liability

To the fullest extent permitted by law, Pixel Forge Design Limited shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability in any circumstance shall not exceed the fees paid by you in the preceding month.

10. Confidentiality

We treat all client information and project details as confidential and will not disclose them to third parties without your consent, except as required by law or to provide the service (e.g. via tools we use).

11. Governing Law

These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.

12. Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers of material changes via email. Continued use of the service after changes are posted constitutes your acceptance of the updated Terms.
